About these terms

This website and the Fiorawall brand are operated by Fiorawall, Inc. ("Fiorawall", "we", "us", "our"). These Terms & Conditions, together with our Privacy Policy, govern your access to and use of our website and any purchase you make from us.

By browsing the site, creating an account or placing an order, you confirm that you have read, understood and agree to be bound by these terms. If you do not agree, please do not use the site or place an order.

Eligibility

To place an order you must be at least 18 years of age and legally capable of entering into a binding contract. By ordering, you confirm that the information you provide is accurate and that you are authorised to use the chosen payment method.

Products, descriptions and colour

We take great care to present our wallpapers and finishes as accurately as possible. However, please keep the following in mind:

• Colours, textures and finishes shown on screen are representations only and may vary depending on your monitor, lighting and device settings.
• Natural variation can occur between print runs, batches and materials. Slight differences in shade or texture are a normal characteristic of wallpaper and not a defect.
• We recommend ordering all wallpaper for a single project together, and ordering a sample before committing to a large order, so you can assess the true colour and texture in your own space.

Pricing and payment

All prices are shown in the currency displayed at checkout and are subject to change without notice, although changes will not affect orders we have already accepted. Unless stated otherwise, prices may exclude shipping, taxes or duties, which will be shown before you complete your order.

Payment must be made in full at the time of ordering through our available payment methods. Payments are processed by secure third-party providers; we do not store full payment card details. We reserve the right to cancel any order where payment is declined, incomplete, or where we reasonably suspect fraud or error.

Orders and acceptance

Your order is an offer to purchase. A contract is formed only when we send you a confirmation that your order has been accepted and/or dispatched. Until then, we may decline or cancel an order for reasons including stock availability, pricing or description errors, or suspected unauthorised activity.

If we cannot fulfil an order after payment, we will notify you and arrange an appropriate refund for the affected items.

Custom and made-to-order products

Many of our products, including custom murals, made-to-measure sizing and personalised designs, are produced specifically for you after your order is placed.

• You are responsible for confirming all specifications, dimensions, files and details before production begins.
• Because these items are made to your specification, they cannot be returned for a change of mind, and once production has started they cannot be cancelled or changed, except where the product is damaged, faulty or not as described.

Shipping and delivery

Delivery timelines provided at checkout or by email are estimates, not guarantees. Delays may occur due to production schedules, courier handling, customs clearance or events beyond our reasonable control.

For international orders, you are the importer of record and may be responsible for any customs duties, taxes or charges applied by the destination country. Risk in the goods passes to you on delivery. Please inspect your order on arrival and report any damage or shortage promptly.

Returns and cancellations

Where a product arrives faulty, damaged or materially not as described, please contact us promptly with your order details and supporting photographs so we can put it right through repair, replacement or refund as appropriate.

Made-to-measure products, including custom, personalised and wall-sized items, are not eligible for a change-of-mind return. Standard-size products can be returned within 30 days of delivery. The return process, timeframes and conditions are set out in our Returns & Refunds Policy, which forms part of these terms.

Measuring and installation

Fiorawall supplies wallpaper and wall-covering products. We do not provide installation services, and installation is carried out at your own responsibility.

• You are responsible for measuring your space correctly and ordering sufficient quantity, including allowance for pattern repeats and wastage. We recommend professional installation.
• We are not liable for issues arising from inaccurate measurements, unsuitable wall conditions, or installation that does not follow the provided instructions.
• Wallpaper should be checked thoroughly before installation. Once a product has been cut or installed, it is treated as accepted.

Intellectual property

All content on this website, including designs, patterns, artwork, images, text, logos and the Fiorawall name, is owned by or licensed to Fiorawall and is protected by intellectual property laws. You may not reproduce, distribute, resell, or create derivative works from our designs or content without our prior written permission. Purchasing a product grants you the right to use it for its intended decorative purpose only, not any rights in the underlying design.

Acceptable use

You agree to use our website lawfully and not to misuse it, including by attempting to gain unauthorised access, disrupt its operation, introduce malicious code, scrape content, or use it for any fraudulent or unlawful purpose. We may suspend or restrict access where we reasonably believe these terms are being breached.

Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity that occurs under your account. Please notify us promptly if you believe your account has been used without your authorisation.

Warranties and limitation of liability

Our website and content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude implied warranties and do not guarantee that the site will be uninterrupted, error-free or free of harmful components.

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law. Subject to that, Fiorawall shall not be liable for indirect, incidental or consequential losses, and our total liability in connection with any product or order shall not exceed the amount paid for that order.

Indemnity

You agree to indemnify and hold Fiorawall harmless from any claims, losses or expenses arising from your breach of these terms, your misuse of the website, or your infringement of any rights of a third party.

Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including courier network disruption, customs holds, extreme weather, industrial action, utility or communications failure, or acts of government. Where such an event occurs we will contact you as soon as reasonably possible and take steps to minimise its effect. If the delay becomes substantial you may contact us to cancel the affected order and receive a refund for anything paid for but not received.

Severability

Each provision of these terms operates separately. If any court or competent authority finds any provision to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be. The remaining provisions stay in full force and effect. A delay in enforcing any provision is not a waiver of it.

Governing law (trade orders)

This section applies only where you order in the course of a business, including under our trade programme, and does not apply to consumer purchases. For such orders, these terms and any dispute arising out of them are governed by the laws of the State of Delaware, USA, and the state and federal courts located in Delaware have exclusive jurisdiction. Nothing in these terms affects the mandatory consumer-protection rights available to you under the law of your country of residence.

Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes in our practices, products or legal requirements. The version in effect at the time you place an order will apply to that order. We will revise the "Last updated" date above whenever changes are made.
